Financiamento de Pesquisa: CNPq Moral e Direito: uma relação peculiar Resumo: O objetivo deste artigo é defender a existência de uma relação peculiar pluridirecional entre a moral e o direito, bem como defender que a moralidade é melhor compreendida por sua autoridade normativa em segunda pessoa, especificamente nos casos que envolvem reivindicações de justiça. Para tal finalidade, inicio esclarecendo as características centrais da moralidade, ressaltando a sua natureza e autoridade normativa intersubjetiva. Morals and Law: a peculiar relationship Abstract: The main aim of this paper is to defend the existence of a peculiar pluridirectional relationship between morals and law, as well as to defend that morality is better understood by its normative authority in second person, specifically in cases involving claims of justice. To this end, I begin by clarifying the central characteristics of morality, highlighting its nature and its normative authority that is intersubjective. Subsequently, I investigate two claims of justice, namely, epistemic injustice and civil disobedience. In conclusion, I suggest a distinction between private and public morality, arguing that this can help us to better understand that there is a pluridirectional relationship between morals and law. The aim of this article is to raise some considerations about the role of category of the overlapping consensus in John Rawls’s theory of justice as fairness in Political Liberalism (Lecture IV), Justice as Fairness: A Restatement (§ 11) and Replay to Habermas (§ 2), with a view to identifying a pragmatical justification model in a public scope, understanding the principles of justice for the basic structure of society as a social minimum that aims at the guarantee of the stability (...) and legitimacy, assuring public criteria for the determination of the principal constitution, economic and social arrangements. With affirmation of the political values of the reasonableness and reciprocity, I’ll identify a pragmatical-universalist justification model with basis in a mitigated intuitionism. (shrink)

I will analyze the core characteristics of the pragmatic presupposition of justification in social contract theory, which uses the argument of social stability and political legitimacy as a guarantee of the legitimacy of the rules, that is, of the principles of justice. I will mainly make use of two articles relevant to this debate: "Justice as Fairness: Political not Metaphysical" and "Reply to Habermas" § 1, 2. Neste artigo pretendo mostrar a importância do conceito de razoável na teoria da justiça como equidade, de John Rawls e também, explicar o problema da razoabilidade nessa teoria. O ponto de partida será ressaltar a exigência de razoabilidade que é feita ao agente moral na justiça como equidade. Posteriormente, procurarei identificar algumas críticas a esse critério. Partirei da crítica formulada por Estlund a respeito do estreitamento do conceito de razoabilidade e a necessidade da verdade e das críticas estabelecidas por Timmons (...) e Gaus sobre a exigência demasiada e ineficaz da razoabilidade. O passo seguinte será tentar responder a essas críticas formuladas e, na parte final do texto, procurarei estipular um argumento a respeito de um tipo de responsabilidade moral razoável que pode estar contida na justiça como equidade. O objetivo deste artigo é estabelecer algumas considerações sobre o papel dos procedimentos de posição original e equilíbrio reflexivo na teoria da justiça como equidade de John Rawls, nas obras A Theory of Justice, Political Liberalism e Justice as Fairness: A Restatement. Eu pretendo mostrar que Rawls faz uso de um modelo coerentista-pragmático de justificação dos princípios de justiça em um âmbito público, que é não-fundacionalista em razão da interconexão entre estes procedimentos.

O principal objetivo desse artigo é responder a questão sobre o que constitui a responsabilidade moral. Tentaremos demonstrar que a responsabilidade moral tem duas características centrais, a saber, exigências internalistas e autoridade social. Para tal propósito, faremos uso de estratégias compatibilistas. O próximo passo será tentar descrever a concepção de responsabilidade substancial de Thomas Scanlon e, no final desse artigo, estipularemos um argumento sobre um tipo de responsabilidade moral razoável que pode estar contida na teoria da justiça como equidade de (...) Este artigo procura traçar relações entre conceitos fundamentais da obra de Walter Benjamin e o pensamento de Giorgio Agamben. Sem pretender esgotar os vínculos entre os dois autores, propomos abordar noções e categorias de Benjamin para compreender suas influências no pensamento de Agamben. Lançando luz sobre essas influências, nosso desafio foi identificar algumas ideias na obra de W. Benjamin que pudessem designar o filósofo alemão como fonte de inspiração para a crítica ao poder e à violência desenvolvida pelo pensador italiano. (...) Por isso destacamos em Benjamin as raízes dos conceitos de vida nua, poder soberano e estado de exceção, que Agamben elabora nas obras I, II e III de seu projeto “Homo Sacer”. Desenvolvemos noções de historiografia, enfatizando a categoria do oprimido e a tarefa de "escovar a história a contrapelo". Os textos benjaminianos que constituem sua teoria política são um verdadeiro arsenal crítico para pensar nossa história e o período entre guerras. A proposta de Agamben, na linha de Benjamin, é que entre as ruínas do passado possamos recolher vestígios e tecer memórias que permitam uma consciência crítica na construção de estilos de vida éticos no presente, contribuindo para as transformações necessárias que nos garantam um futuro de justiça social. Assumindo o campo de concentração como paradigma dessa relação, a identificação com as vítimas da violência, em Agamben, segue as indicações de Benjamin sobre a tarefa crítica: lançar nova luz sobre os fatos, dar voz aos que foram vítimas da violência, oprimidos e silenciados pelo poder soberano. ACESSO À JUSTIÇA: DELINEAMENTOS GERAIS E ANÁLISE NO PROJETO DE NOVO CÓDIGO PROCESSUAL CIVIL.

This study examines interactions in which students help each other with their learning during classroom instruction, forming groups in the process. From a conversation analytic perspective, helping is assumed to be a sequentially organized activity jointly accomplished by the participants. As an activity that proceeds alongside other ongoing classroom activities, helping can be conceived as part of a multiactivity that poses students with multi-faceted interactional and moral challenges. While previous research on helping in educational contexts has primarily focused on the (...) influence of helping on learning outcomes and social dynamics in helping interactions, the present study investigates how students cope with the intricacies of moral commitments inherent in helping as a concurrent activity. The aim of this paper is two-fold. First, we aim to elaborate on how students’ dual involvements – i.e., their involvement in classroom activities while simultaneously providing help – manifest in the ways in which groups are constituted, maintained, and dissolved. The analyses reveal that both the compatibility of helping with the activity already in progress as well as the students’ problem definition are consequential for the sequential and bodily-spatial unfolding of the help interaction, inducing different arrangements that constitute a continuum, at each end of which there is a dominant orientation toward the shared space of helping or toward the individual/collective space. Furthermore, from a methodological perspective, our study aims to demonstrate the extent to which multimodal interaction analysis is applicable when examining naturally occurring groups, in this case, in interactive processes of helping. The study is based on a data corpus that comprises video recordings of mathematics and German lessons from two fifth-grade classrooms. (shrink)

A new research area linked to ethics, virtues, and morality is servant leadership. Scholars are currently seeking publication outlets as critics debate whether this new leadership theory is significantly distinct, viable, and valuable for organizational success. The aim of this study was to identify empirical studies that explored servant leadership theory by engaging a sample population in order to assess and synthesize the mechanisms, outcomes, and impacts of servant leadership. Thus, we sought to provide an evidence-informed answer to how does (...) servant leadership work, and how can we apply it? We conducted a systematic literature review (SLR), a methodology adopted from the medical sciences to synthesize research in a systematic, transparent, and reproducible manner. A disciplined screening process resulted in a final sample population of 39 appropriate studies. The synthesis of these empirical studies revealed: (a) there is no consensus on the definition of servant leadership; (b) servant leadership theory is being investigated across a variety of contexts, cultures, and themes; (c) researchers are using multiple measures to explore servant leadership; and (d) servant leadership is a viable leadership theory that helps organizations and improves the well-being of followers. This study contributes to the development of servant leadership theory and practice. In addition, this study contributes to the methodology for conducting SLRs in the field of management, highlighting an effective method for mapping out thematically, and viewing holistically, new research topics. Prior researchers have studied individual components of a theoretical decision-making model. This paper presents the results of a more complete study of the model components and presents limited support of theory. The study examines the relative importance of regulatory, organizational, and personal constructs on an individual''s ethical sensitivity. Auditors from the major international accounting firms, located in two southeastern cities, are surveyed. Structural equation modeling is used to allow for the simultaneous evaluation of the three constructs of interest. The results (...) indicate that the regulatory and organizational constructs are negatively correlated with the personal experience construct. The three constructs are not significant causal factors on ethical sensitivity. This result may be due to the manner in which ethical sensitivity is typically measured or may indicate that the complexity of the ethical decision-making process is not fully captured in the theoretical models. Thus, the models suggested in the prior literature and the results presented in prior studies of the individual components may need to be reconsidered. (shrink)

The main aim of this paper is to propose the inclusion of the expertise of a prudent agent in the reflective equilibrium procedure, adding a disposition to identify reasonable beliefs that would be seen as the starting point of the method, which could avoid the criticism of conservatism and subjectivism. To do so, I will begin by analyzing the central characteristics of the method and its main faults. Afterwards, I will investigate the characteristics of prudence as a disposition to identify (...) the adequate means to achieve a good end. With this in mind, I will apply prudence to the procedure, so that it will be carried out by an agent who deliberates well, identifying reasonable moral beliefs and, then, we must justify them based on their consistency with ethical principles and with the factual beliefs of relevant scientific theories. Finally, I will argue that this deliberative process is consistent with ethical pluralism and democracy, and can be taken as a kind of moral knowledge. (shrink)

Mediating the meaning of evidence through epistemological diversity Nursing's disciplinary recognition of ‘multiple ways of knowing’ reflects an epistemological diversity that supports nursing praxis. Nursing as praxis offers a conceptual way to explore what it is about the interface of practice, knowledge and evidence in nursing that distinguishes us as a discipline. I suggest that the relationship between evidence and knowledge is defined and mediated by the same epistemological diversity that supports nursing as praxis. Just as the meaning and truth‐value (...) of evidence is evaluated from within the body of existing disciplinary knowledge, new evidence may prompt an evaluation of the meaning and truth‐value of extant nursing knowledge. Nursing practice that relies on scientific evidence as a singular basis of practice knowledge is susceptible to exploitation by the diverse agendas operating within an ideology of evidence‐based practice and the healthcare system. Mediating the meaning of evidence for nursing practice through acknowledgement of the diverse epistemologies that underpin nursing knowledge will contribute to a disciplinary‐specific definition of what constitutes evidence for nursing, and will better direct how evidence is integrated into a disciplinary body of knowledge. Over several articles, John McDowell sketches an analogy between virtue and perception, whereby the virtuous person sees situations in a distinctive way, a way that explains her virtuous behavior. Central to this view is his notion of silencing, a psychological phenomenon in which certain considerations fail to operate as reasons in a virtuous person's practical reasoning. Despite its influence on many prominent virtue ethicists, McDowell's ‘silencing view’ has been criticized as psychologically unrealistic. In this article, I defend a silencing view (...) of practical reasoning. I argue that the phenomenon of silencing has a narrower scope than is typically acknowledged. As a result, the view does not require the virtuous to be detached, unfeeling, or unpalatably stoic. Furthermore, I offer a psychologically plausible interpretation of McDowell's claim that the virtuous see situations in a distinctive sort of way. The salient fact at which the virtuous arrive in their view of a situation should be understood, I argue, in terms of subjective construal. (shrink)

BackgroundDecision-making in initiating life-sustaining health technology is complex and often conducted at time-critical junctures in clinical care. Many of these decisions have profound, often irreversible, consequences for the child and family, as well as potential benefits for functioning, health and quality of life. Yet little is known about what influences these decisions. A systematic review of reasoning identified the range of reasons clinicians give in the literature when initiating technology dependence in a child, and as a result helps determine the (...) range of influences on these decisions.MethodsMedline, EMBASE, CINAHL, PsychINFO, Web of Science, ASSIA and Global Health Library databases were searched to identify all reasons given for the initiation of technology dependence in a child. Each reason was coded as a broad and narrow reason type, and whether it supported or rejected technology dependence.Results53 relevant papers were retained from 1604 publications, containing 116 broad reason types and 383 narrow reason types. These were grouped into broad thematic categories: clinical factors, quality of life factors, moral imperatives and duty and personal values; and whether they supported, rejected or described the initiation of technology dependence. The majority were conceptual or discussion papers, less than a third were empirical studies. Most discussed neonates and focused on end-of-life care.ConclusionsThere is a lack of empirical studies on this topic, scant knowledge about the experience of older children and their families in particular; and little written on choices made outside ‘end-of-life’ care. This review provides a sound basis for empirical research into the important influences on a child’s potential technology dependence. (shrink)

Job burnout, organizational commitment, and work environment continue to be important areas of research to be studied in the realm of company employment and employee retention. Job burnout is the state of physical and emotional exhaustion and perceiving one’s profession as dull or overwhelming. Meanwhile, organizational commitment refers to the company’s attitude towards the organization and their employees, encompassing loyalty, moral responsibility, and their willingness to work. And lastly, work environment provides opportunities for employees to establish connections, develop skills, and (...) maximize their full potential in performing tasks. For the current study, researchers utilized descriptive-correlational research design to investigate the influence of Work Environment towards the job burnout and organizational commitment of BPO agents in selected companies in Bulacan, Philippines. Hence, Danish Psychosocial Work Environment Questionnaire (DPQ), Maslach Burnout Inventory - General Survey (MBI-GS), and the Three-Dimensional Model of Organizational Commitment Scale (ACS, NCS, CCS) were employed to properly assess the study's objectives. Multiple Linear Regression Analysis was performed to analyze the collected data. Based on the analysis, findings show that work environment has no significant influence on the job burnout and organizational commitment of BPO Agents. Furthermore, the results of this study were thoroughly evaluated, leading to an in-depth discussion. Based on the findings, recommendations were made to benefit the stakeholders of the study and contributeto the existing body of knowledge. (shrink)

The central goal of this paper is to investigate the injustices that can occur with the use of new technologies, especially Artificial Intelligence (AI), focusing on the issues concerning respect to human rights and the protection of victims and the most vulnerable. We aim to study the impacts of AI in daily life and the possible threats to human dignity imposed by it, such as discrimination based on prejudices, identity-oriented stereotypes, and unequal access to health services. Surgical innovation involves practices, such as new devices, technologies, procedures, or applications, which are novel and untested. Although innovative practices are believed to offer an improvement on the standard surgical approach, they may prove to be inefficacious or even dangerous. This article considers how surgeons considering innovation should reason in the conditions of uncertainty that characterize innovative surgery. What attitude to the unknown risks of innovative surgery should they take? The answer to this question involves value judgments about the acceptability (...) of risk taking when satisfactory scientific information is not available. This question has been confronted in legal contexts, where risk aversion in the form of the precautionary principle has become increasingly influential as a regulatory response to innovative technologies that pose uncertain future hazards. This article considers whether it is appropriate to apply a precautionary approach when making decisions about innovative surgery. (shrink)

He omits none of the pleasures of the palate, great or (...) small. In his Latin poems, when young, he speaks of the pears and chestnuts which he used to roast at the fire with his friend Diodati. Junkets and other "country-messes" are not forgotten in his "Allegro." The simple Temptation in the Wilderness, "Command that these stones be made bread" (which was quite sufficient for a hunger that had fasted "forty days"), is turned, in Paradise Regained, with more poetry than propriety, into the set out of a great feast, containing every delicacy in and out of season. The very "names" of the viands, he says, were "exquisite." For as this essay will show, Milton complicates the category of physiological taste in such a manner as to form the ground for the possibility of aesthetic taste, which emerges as a distinct discourse in the early years of the eighteenth century. What I would like to suggest is that just as Milton is a seminal figure for the eighteenth-century aesthetic preoccupation with the sublime, 1 he is theoretically situated at the origins of the more generic thing called taste as well. Institutionalist theory tends to de-emphasize how actors deliberately construct social arrangements such as parenting roles within the family. The authors' analysis of interviews from 14 lesbian mothers remedies this deficiency by focusing both on how they draw upon and (...) transform institutionalized scripts, practices, and understandings of family roles and relations. Their findings reveal how these mothers reinscribed gendered understandings while simultaneously challenging heteronormative ones in their efforts to construct and maintain socially viable two-parent families. This article explores the process and meaning of occupational mobility among a selected sample of 40 immigrant and nonimmigrant women of Mexican descent in the San Francisco Bay Area who entered the secondary labor market of semiskilled clerical, service, and operative jobs in 1978-1979 and 1980-1981. This labor market was segmented along race and gender lines with few promotional ladders available as the work force became more nonwhite and female. When Chicanas and Mexicanas obtained jobs with fewer Chicano coworkers and (...) greater avenues for advancement, they reported escalating conflictual social relations at work. Occupational mobility contained both objective and subjective dimensions for the respondents. Often a woman felt mobile in a job that lacked the means for advancement because she compared herself to a local Chicano or Mexicano working-class reference group and a self-concept rooted in her class, race, and gender. In such 3D virtual environments (3DVEs) as Second Life, one can ‘be’ re-created as avatar in whatever form one wants to be, facilitated by extensive beauty and cosmetic industries to help the residents of this world achieve a particular kind of glamorous image – limited only by their imaginations and Linden Dollar accounts. Yet, others in 3DVEs are working hard to re-create their avatars to be replicas of their ‘offline’ selves, appearing as they do in actuality. Such phenomena provide a (...) rich opportunity to explore the cultural contexts of ‘self-making’, the process of ‘becoming’ and the transformative, often transgressive, processes of ‘beauty practices’ as bodily praxis and serious play. Drawing on their international ethnographic research undertaken in Second Life, the authors explore the phenomenon of image, affect, subjectivity and representation in this alternative arena. We focus specifically on three interrelated and paradoxical aspects of self-making in this 3D virtual world: first, the ways in which many of our respondents described their avatar personae as symbolically representing their ‘authentic inner selves’; second, the ways our respondents used photography and video to verify and authenticate these ‘inner selves’, through capturing representations of their avatar bodies in action; and, third, the ways ‘authenticity’, for many of our respondents, depended on their avatar image aligning as closely as possible with their bodily appearance off-screen. The concept of what residents of Second Life understand as constituting the ‘authentic inner self’ both in and outside of the virtual world becomes particularly pertinent here. (shrink)

When reasoning about deontic rules (what one may, should, or should not do in a given set of circumstances), reasoners adopt a violation‐detection strategy, a strategy they do not adopt when reasoning about indicative rules (descriptions of purported state of affairs). I argue that this indicative‐deontic distinction constitutes a primitive in the cognitive architecture. To support this claim, I show that this distinction emerges early in development, is observed regardless of the cultural background of the reasoner, and can be selectively (...) disrupted at the neurological level. I also argue that this distinction emerged as a result of selective pressure favouring the evolution of reasoning strategies that determine survival within dominance hierarchies. (shrink)

An experiment was conducted to investigate the relative contributions of syntactic form and content to conditional reasoning. The content domain chosen was that of causation. Conditional statements that described causal relationships (if (cause>, then (effect>) were embedded in simple arguments whose entailments are governed by the rules -oftruth-functional logic (i.e., modus ponens, modus tollens, denying the antecedent, and affirming the consequent). The causal statements differed in terms ofthe number of alternative causes and disabling conditions that characterized the causal relationship. (A (...) disabling condition is an event that prevents an effect from occurring even though a relevant cause is present.) Subjects were required to judge whether or not each argument’s conclusion could be accepted. Judgments were found to vary systematically with the number of alternative causes and disabling conditions. Conclusions of arguments based on conditionals with few alternative causes or disabling conditionswerefoun~d:tobe-rnore accept~ able than cdnclusions based on those with many. (shrink)
